Terms and Conditions for Olivia Rose Online Store
These Terms and Conditions (“Agreement”) govern the use of our online wedding dress store (“Store”) operated by Olivia Rose Bridal Ltd (“Company,” “we,” or “us”). By accessing or using our Store, you agree to be bound by these Terms and Conditions and any additional guidelines or rules applicable to specific products or services provided by us. If you do not agree with these terms, please do not use our Store.
Ordering and Purchase
1.1 Product Descriptions: We strive to provide accurate and detailed descriptions of our wedding dresses. However, please note that colors, textures, and other details may vary slightly due to individual monitor settings and handmade nature of the dresses.
1.2 Made-to-Order Dresses: The majority of our dresses are handmade for each individual order and require a considerable amount of time for production. Once an order is placed, the customer acknowledges and accepts that the production process will take approximately 4-6 months.
1.3 Order Cancellation: As our dresses are made-to-order, cancellations can only be made within 48 hours of placing the order. After this period, the customer is obligated to proceed with the purchase.
1.4 Measurements and Customization: It is the customer’s responsibility to provide accurate measurements and customization details at the time of placing the order. We cannot be held liable for any inaccuracies or changes requested after the order has been placed.
Returns and Exchanges
2.1 Return Policy: Due to the personaliSed and handmade nature of our dresses, returns and exchanges are generally not accepted unless specifically stated otherwise or required by New Zealand law.
2.2 Quality Control: We have rigorous quality control measures in place to ensure that each dress is carefully inspected before shipment. In the unlikely event that a manufacturing defect or error occurs, please contact our customer support within seven (7) days of receiving the dress.
2.3 Exceptions: Returns or exchanges may be considered under the following circumstances:
a. The dress received does not match the customization details provided by the customer.
b. The dress received has significant defects or damage caused during the manufacturing process.
2.4 Return Authorization: For eligible returns or exchanges, the customer must obtain prior authorization from our customer support team. We reserve the right to refuse any returns or exchanges that do not comply with our policies.
2.5 Return Shipping: If a return or exchange is approved, the customer will be responsible for the cost of return shipping. The returned dress must be in its original condition, unworn, and with all tags and labels attached.
Intellectual Property
3.1 Ownership: All intellectual property rights, including but not limited to trademarks, logos, designs, images, and content, associated with our Store are the sole property of the Company.
3.2 Prohibited Use: You are prohibited from reproducing, distributing, modifying, or using any of our intellectual property without our explicit written consent.
Limitation of Liability
4.1 Except where prohibited by law, the Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of our Store or the purchase of our products.
4.2 To the extent permitted by law, our liability for any breach of these Terms and Conditions is limited to the purchase price of the product or service in question.
Governing Law and Jurisdiction
5.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of New Zealand.
5.2 Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of New Zealand.
